Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...) Indigenous communities, individuals with certain disabilities, and low-income persons. However, many health systems have resorted to first-come, first-served approaches to allocation, which tend to disadvantage individuals with barriers in access to care (3). There is mounting evidence of racial, ethnic, and socioeconomic disparities in access to medications for COVID-19 (4, 5). -/- One potential method to promote equitable allocation is to use a weighted lottery, which is an allocation strategy that gives all eligible patients a chance to receive the scarce treatment while also allowing the assignment of higher or lower chances according to other ethical considerations (6). We sought to assess the feasibility of implementing a weighted lottery to allocate scarce COVID-19 medications in a large U.S. health system and to determine whether the weighted lottery promotes equitable allocation. The coronavirus disease 2019 (COVID-19) pandemic has motivated medical ethicists and several task forces to revisit or issue new guidelines on allocating scarce medical resources. Such guidelines are relevant for the allocation of scarce therapeutics and vaccines and for allocation of ICU beds, ventilators, and other life-sustaining treatments or potentially scarce interventions. Principles underlying these guidelines, like saving the most lives, mitigating disparities, reciprocity to those who assume additional risk (eg, essential workers and clinical trial participants), and equal access may (...) compete with one another. We propose the use of a “categorized priority system” (also known as a “reserve system”) as an improvement over existing allocation methods, particularly because it may be able to achieve disparity mitigation better than other methods. As clinical ethics consultants move toward professionalization, the process of certifying individual consultants or accrediting programs will be discussed and debated. With certification, some entity must be established or ordained to oversee the standards and procedures. If the process evolves like other professions, it seems plausible that it will eventually include a written examination to evaluate the core knowledge competencies that individual practitioners should possess to meet peer practice standards. The American Society for Bioethics and Humanities has published core knowledge (...) competencies for many years that are accepted by experts as the prevailing standard. Probably any written examination will be based upon the ASBH core knowledge competencies. However, much remains to be done before any examination may be offered. In particular, it seems likely that a recognized examining board must create and validate examination questions and structure the examination so as to establish meaningful, defensible parameters after dealing with such challenging questions as: Should the certifying examination be multiple choice or short-answer essay? How should the test be graded? What should the pass rate be? How may the examination be best administered? To advance the field of health care ethics consultation, thought leaders should start to focus on the written examination possibilities, to date unaddressed carefully in the literature. Examination models—both objective and written—must be explored as a viable strategy about how the field of health care ethics consultations can grow toward professionalization. (shrink)

Focusing on David B. Riazanov career and his pioneering efforts in producing a complete edition of the works of Marx and Engels, the article explains why Riazanov’s variety of Marxism was unacceptable to the Soviet regime, and why from 1924 Lenin was credited with being an outstanding Marxist theoretician, whereas previously he had been regarded only as a skilled political activist. The concept of Leninism as a new stage of Marxism was put forward by Bukharin and elaborated on by Stalin (...) and Zinoviev. Georg Lukács attempted to show that Lenin’s thought had the internal coherence that Bukharin postulated. In support of Lenin’s theoretical credentials, his ‘Philosophical Notebooks’ began to be published from 1925. However, neither Riazanov nor his associate Abram M. Deborin subscribed to the official doctrine that Leninism was a new and higher stage of Marxism. For this stance they fell victim to Stalin’s repression. (shrink)

In this chapter, the author talks about some of the finer points concerning Captain America and his eligibility to serve as a moral exemplar. The chapter explores three issues. 1) Fictional characters are simply not real. 2) Fictional characters can be perfect and we can't. 3) Fictional characters can be depicted inconsistently over the years by different writers. Fictional characters can model virtuous character traits by demonstrating their consequences in an imaginary world that readers identify with. While real‐world people can't (...) be perfect, fictional characters can be: writers just have to write them that way! Depending on how they are written, fictional characters don't have to experience difficult choices or moral weakness, and they can stick to their principles come what may. Each writer and fan will have a personal conception of a character like Captain America that leads them to regard certain behaviors as mistakes, aberrations caused by writers. (shrink)

Abstract As non-state actors, PMSCs are not embraced by traditional state-dominated doctrines of international law. However, international law has itself failed to keep pace with the evolution of states and state-based actors, to which strong Westphalian notions of sovereignty are no longer applicable. It is argued that these structural inadequacies stand in the way of international regulation of PMSCs, rather than defects in international human rights and humanitarian law per se. By analyzing understandings of legal responsibility, where such structural issues (...) come to the fore, it is argued that, rather than attempting to resolve the essentially ideological dispute about the inherent functions of a state, regulatory regimes should focus on the positive obligations of states and PMSCs, and the interactions between them. Applying the results of this analysis, current and proposed regulatory regimes are evaluated and their shortcomings revealed. (shrink)

This chapter looks at another executive virtue that Captain America exemplifies: the judgment he needs to arrive at the best action in a difficult situation. Despite his humility, Captain America exemplifies both sound judgment and unshakeable determination, which are often misunderstood as representing “black‐and‐white” ethics or stubbornness. Just like judges as Dworkin describes them, we can use our own judgment to find the “right answer” to each moral dilemma, the decision that is consistent with our own principles and maintains (...) the integrity of our own moral character. There is a special category of situations that superheroes all too often find themselves in. Such choices are what philosophers call tragic dilemmas. Applying basic moral virtues and principles to specific circumstances, including all of their context, nuance, and subtlety, is the key to sound judgment, and that is important to everyone in the real world and to Cap in the comics. The criticism has been made that Kant looks racist, at least in his early work. This, however, is to insist on a literal reading. I explore Kant’s use of irony and satire as he battles to defend his vision. I show the rhetoric of irony in a pivotal text, looking at what happens and why.

This chapter argues that while we are polarized on narrowly defined issues, we agree on more basic principles, ideals, and goals‐which don't get as much attention in the media compared to arguments over how we should pursue them. Captain America not only defended justice, equality, and liberty to the Red Skull, but has represented them as the core ideals of the United States of America. Refocusing our attention on these ideals, remembering our common points while debating differences, is the first (...) step towards recovering a sense of national unity and restoring civility to our political life. All it takes is the determination to be better and the judgment to decide how to be excellent at what we want to do and who we want to be, and to work together to help create the society we want to live in. Many experiences in life appear to us as very good when we remember oranticipate them, but quite ordinary or downright bad in the moment. Most people will cite parenting as a marvellous, transcendent life adventure. But most of the day-to-day tasks of childrearing are mundane at best, disgusting at worst: changing diapers, wiping up spills, shuttling little ones from activity to activity, and bailing them out of jail.

This chapter focuses on the “America” part of Captain America's name and explores the more political aspects of his life and character. It looks at patriotism in general and how to characterize Captain America's brand of it; Cap's uneasy relationship with politics and the United States government; and how Cap puts principles above politics, even if it means defying his own government and giving up the shield and the title. The chapter explains that Cap's devotion to his country is based (...) on the principles and ideals upon which it was founded, and he regularly holds his government accountable to those same standards, which he interprets as inclusive and cosmopolitan, applying to the world outside America as well as everybody within it. It dispels any illusions that Captain America is a jingoist flag‐waver, and explains instead that he embodies an inclusive and cosmopolitan patriotism that balances idealism with clear‐eyed pragmatism. As the Sorcerer Supreme, Doctor Stephen Strange is Earth's sole protector from mystical forces that threaten its very existence. This chapter explores several ways in which Strange fails to operate with the proper balance between extremes, what moral philosophers in the tradition of virtue ethics call the “golden mean”. As a medical doctor, Strange was living his life at the extremes. Strange's carefree and reckless lifestyle helped contribute to the automobile accident that crushed his hands, ending his medical career and (...) leading him to seek out the mystical healing powers of the Ancient One. After his accident, Strange gained humility and perspective, appreciating the value of life and dedicating his own to protecting humanity. Even though Doctor Strange is overly zealous in how he prioritizes his mission as Earth's mystical defender over his personal life, the choices he makes in pursuit of that mission are nuanced. In “A Modest Proposal: Accounting for the Virtuousness of Modesty,” Irene McMullin characterizes the modest person as striking a delicate balance between accurate self-assessment and sensitivity to the feelings of others. She criticizes ‘egalitarian’ understandings of this process as unrealistically demanding, and instead proposes an account based on Sartrean facticity and self-awareness. In this brief comment, I defend the egalitarian accounts, arguing for a specifically Kantian explanation of modesty that combines the best of both the egalitarian and Sartrean views, and (...) is based on basic Kantian concepts of dignity and autonomy. On this account, the modest person honestly assesses her own successes according to her autonomously determined standards, yet exhibits modesty to others out of the recognition of the equal worth and dignity of all persons. This book explores the steady decline in the status of the individual in recent years and addresses common misunderstandings about the concept of individuality. Drawing from psychology, neuroscience, technology, economics, philosophy, politics, and law, White explains how and why the individual has been devalued in the eyes of scholars, government leaders, and the public. He notes that developments in science have led to doubts about our cognitive competence, while assumptions made in the humanities have led to questions about our (...) moral competence. The chapter argues that Captain America's supposed “black‐and‐white” ethics weren't simplistic in the 1940s, they are just as applicable now as they were then. Captain America's tremendous willingness to sacrifice can be traced to his oversized sense of responsibility. Perseverance is what philosophers call an executive virtue because it helps people follow through on their judgment made in light of their virtues and principles. This chapter provides a quick primer on the volumes of the comic titles Captain America and Avengers. It talks about the beginnings and endings of which usually coincide with major events in the Marvel Universe. The story starts with the first volume of Avengers, since it was in the classic issue #4 of that title that Captain America was found in a block of ice and revived. These long‐running volumes of Captain America and Avengers lasted until 1996. Both series ended (...) when the Avengers were apparently killed in a battle with the villainous Onslaught. After the Avengers vs. X‐Men event, Marvel Comics relaunched many of its books and introduced new ones. The Watcher only knows what volume Captain America and the various Avengers titles are on, but Cap will live in on comics, movies, and TV long after this book has changed the course of American history. Killing is a topic that divides superhero fans like no other. Wonder Woman is a curious case, though. Traditionally associated with compassion and love, Diana is also a fierce warrior. While seeing Wonder Woman's choice through the lens of moral philosophy, it would seem that the deck is stacked against Lord in terms of one school of ethics, consequentialism. Consequentialism requires that we make a moral decision by choosing the option with the best (or least bad) outcomes. The simple math (...) dictates that Wonder Woman can guarantee the least loss of life by killing Max Lord. The decision Wonder Woman faced with respect to Max Lord closely resembles the one Superman faced when three renegade Kryptonians, each more powerful than Superman, wiped out the entire population of an Earth in an alternate dimension and threatened to do the same in his. Properly speaking, money and law are natural outgrowths of human society, evolving over time via the voluntary cooperation that lies at the heart of the social enterprise. And as gold and the golden rule have for millennia formed the basis, respectively, of society’s money and law, they accordingly constitute the “twin pillars of civilization,” governing the social enterprise such that, in Mises’s words, “the human species has multiplied far beyond the margin of subsistence.” It stands to reason, then, that if (...) money and law are corrupted, the social enterprise will be corrupted as well. And as this is precisely what the state has done, essentially toppling the twin pillars of civilization, it is necessary to understand what the state is, where it came from, and how it has systematically gone about corrupting money and law, and thus the social enterprise as a whole. For only then can money and law be returned to their rightful owners, and only then can the state be put in its proper place. T'Challa, the Black Panther, wears many hats, both at home and abroad. He is the chieftain of the Panther Tribe, which makes him the spiritual leader of his people as well as the king of Wakanda and its head of state. One key aspect that separates virtue ethics from its rival moral theories, consequentialism and deontology, is its focus on character. Judgment, or what Aristotle called "practical wisdom", is the ability to decide how best to act on one's virtues in (...) a particular situation. When T'Challa believed that agents within the US government were helping to overthrow his own, he and the Dora Milaje drove a truck into a building and abducted a businessman involved in the operation. This chapter talks about three basic schools of ethics—utilitarianism, deontology, and virtue ethics. This discussion will not only help people situate Captain America's ethics within moral philosophy more broadly, but also help people understand the ethical points of view of other people in the Marvel Universe. Many virtue ethicists, especially Aristotle, emphasize the importance of role models or moral exemplars, people who demonstrate good behavior for others to emulate. The chapter explains that while utilitarianism is easy to define and deontology less clear‐cut, virtue ethics is the most difficult to nail down because it comes in many varieties.
